SLABWARE — USER TERMS AND CONDITIONS

1. Preliminary Considerations and Acceptance
The acceptance of these General Terms and Conditions is absolutely indispensable for the use of the software. By clicking the acceptance box, the User declares to have read, understood, and accepted the most recent version of these Terms, automatically binding themselves to the rules established herein.
This instrument regulates the use of SaaS (Software as a Service) services provided by DPF SISTEMAS LTDA., a private legal entity, registered with the CNPJ under No. 17.363.982/0001-89, headquartered at Rua Gastão Roubach, Number 36, Ed. Moviment Mall Praia da Costa – Vila Velha – ES – Brazil, CEP 29101-020.
2. Purpose
The platform's purpose is to license the use of the SlabWare software and its digital assets, including the website, applications, and other tools that assist the complete management of companies in the ornamental stone industry.
SlabWare provides, through electronic remote leasing, functionalities that cover:
- material management;
- manufacturing control;
- sales;
- administrative routines;
- online catalog;
- external integrations;
- and other modules updated over time.
3. Acceptance of Conditions
The use of the platform implies the full and unrestricted acceptance of these Terms. Should the User disagree with any clause, they must refrain from using the service.
These Terms remain valid for an indefinite period, as long as the platform is being used.
This Term establishes obligations voluntarily contracted, for an indefinite period, between the platform and individuals or legal entities who use the website or application.
By using the platform, the user fully accepts these rules and commits to always remain attentive to them, under penalty of application of the applicable sanctions.
The acceptance of this instrument is indispensable to access and use any services provided by the company. Should the user disagree with the provisions presented herein, they must not use them.
4. User Access
SlabWare adopts all available technical solutions to keep the service accessible 24 hours a day, 7 days a week.
However, access may be interrupted, limited, or suspended for:
- updates;
- corrections;
- maintenance;
- structural changes;
- external factors, such as instability of third-party servers, data centers, or external providers.
SlabWare does not guarantee uninterrupted availability, recognizing that technical failures are inherent to the digital environment.
5. User Registration
Access to certain features of the platform depends on prior registration and, according to the contracted plan, the corresponding payment.
To complete the registration, the User must provide true, complete, up-to-date, and valid data, and it is their sole responsibility to keep this information correct at all times. The User declares and undertakes that all information provided is accurate and authentic.
Upon completing the registration, the User will receive a personal login and password, and is exclusively responsible for the safekeeping, secrecy, protection, and confidentiality of these credentials. The User commits to:
- provide true, complete, and up-to-date data;
- maintain the password in absolute secrecy;
- not pass on, assign, sell, rent, or transfer access credentials to third parties;
- be over 18 years of age or possess express authorization from the legal guardian to use the platform.
Any activity carried out using the login and password will be considered the User's responsibility. In case of suspicion or confirmation of improper use, unauthorized access, or security breach, the User must immediately notify SlabWare so that the appropriate measures can be taken.
The User must provide a valid email address, through which all official communications from the platform will occur, including notifications, contractual communications, billing notices, and administrative messages.
Minors under 18 or persons who do not have full civil capacity may only use the platform with the express authorization of their legal guardians, who are fully responsible for the use made. If registration is carried out without this authorization, all resulting responsibility will be attributed exclusively to the legal guardians.
It is the User's responsibility to ensure that their devices, equipment, browsers, and technological infrastructure meet the technical characteristics necessary for the full use of the platform, including hardware, software, and internet connection requirements.
The User may request the cancellation of their account at any time through the official channels: [email protected] or www.slabware.com, provided there are no financial outstanding debts. Cancellation does not imply automatic deletion of data processed in accordance with the legal and contractual purposes provided in the Privacy Policy.
By accepting these Terms of Use and the Privacy Policy, the User declares to be fully aware and agrees that SlabWare may collect, use, store, share, and process personal data and other information arising from the use of the platform and services, including those provided during registration or subsequent updates, in compliance with the General Data Protection Law — LGPD (Law No. 13.709/2018).
Data processing may include, among other activities: collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation, control, modification, communication, transfer, and dissemination of data, when necessary to:
- enable the creation, maintenance, and management of the User's account;
- allow the regular use of the platform's features;
- comply with legal or regulatory obligations;
- ensure the application's security, fraud prevention, and User protection;
- exercise rights in judicial, administrative, or arbitration proceedings;
- enhance the User experience and the quality of the services provided.
All processing operations will be carried out in accordance with the stated purposes, applicable legal bases, and the limits established by the LGPD.
6. Pricing, Billing, and Automatic Renewal
Service fees may be unilaterally updated by the platform, without the need for prior individual communication. The prices displayed at the time of contracting are the current ones.
All fees are presented in United States Dollars (USD), excluding taxes, which will be informed prior to billing.
Upon contracting the service, the User may enter financial data, such as a credit card or billing address. SlabWare does not store complete credit card data, using external payment providers that follow international PCI-DSS security standards.
6.1 Responsibility for Credit Card
Upon entering payment information, the User declares that:
- He/She is the cardholder of the card used, or has express authorization from the cardholder;
- acknowledges that data entry is done under their exclusive responsibility;
- authorizes the recurring charge of the amount corresponding to the contracted plan;
- understands that the system uses external and secure processing providers (Stripe/PayPal or equivalents).
SlabWare is not responsible for:
- typing errors or incorrect data submission by the User;
- blocked, expired, or maxed-out cards;
- unilateral cancellations made by the operator (card issuer);
- undue disputes originating from incorrectly entered information.
6.2 Automatic Renewal
The contract is automatically renewed in the same cycle chosen by the User, with periodic billing using the same registered payment method, until cancellation occurs.
6.3 Price Adjustment
The fees may be adjusted annually, according to the IGPM (Brazilian price index) or another index that replaces it.
7. Cancellation of Services
The service may be canceled by both the User and the Platform, under the conditions described below.
7.1 Cancellation by the User
- The User may, at any time, request the cancellation of the services through the tools made available on the platform itself or through other official channels indicated by SlabWare.
- The cancellation promoted by the User does not imply the immediate interruption of the already contracted service, so that:
- the service will remain active until the end of the usage cycle already paid for; and
- there will be no refund or proportional reimbursement of amounts related to the remaining period, except in the cases provided by law or expressly indicated in specific SlabWare policies.
- To avoid billing for a new usage cycle, it is recommended that the cancellation be requested with a minimum advance notice of 01 (one) day before the date scheduled for automatic renewal.
- No fine or penalty will be charged for simple cancellation, without prejudice to the collection of amounts that may already be due and unpaid up to the date of the cancellation request.
7.2 Cancellation or Suspension by the Platform
SlabWare may, regardless of prior notice and without any compensation or reimbursement being due to the User, suspend or cancel access to the services, totally or partially, in the following circumstances:
- violation of these Terms of Use, the Privacy Policy, or other applicable policies;
- commission of illegal acts or use of the platform contrary to current legislation;
- User default regarding any amount due, after the maximum tolerance period of 10 (ten) consecutive days, counted from the date of the open obligation;
- use of the platform in a way that may cause damage, risk, or loss to SlabWare itself, other Users, or third parties.
Whenever possible, SlabWare may notify the User about the suspension or cancellation, informing, when applicable, the necessary measures for regularization.
Cancellation by either party does not waive SlabWare's right to collect amounts due until the date of effective termination, nor does it prejudice the User's liability for any violations already committed.

9. Responsibilities of the Parties
✔ User's Responsibilities:
- Use the platform ethically and lawfully;
- Maintain their device, internet, and infrastructure suitable for use;
- Protect their credentials;
- Respect applicable legislation and these Terms.
✔ SlabWare's Responsibilities:
- Make the software available as per the service description;
- Make the software available as per the service description;
- Protect personal data in accordance with the LGPD;
- Keep service information clear and up-to-date.
SlabWare is not responsible for:
- problems arising from the User's equipment;
- failures of third parties (operators, gateways, providers, banks);
- loss of data due to the User's exclusive fault;
- commercial, financial, or operational decisions made by the User based on data entered into the system;
- occasional unavailability inherent to online services.
The Platform may contain external links, without responsibility for any content that can be accessed on those links.
10. Copyright and Intellectual Property
All content related to SlabWare — trademarks, codes, layouts, database, interface, texts, images, videos, and other elements — is the exclusive property of DPF SISTEMAS LTDA., protected by Laws No. 9.609/98, 9.610/98, and 9.279/96.
It is prohibited to:
- modify, copy, or distribute the software;
- perform reverse engineering;
- use SlabWare for illicit purposes;
- sublicense its use;
- assign or transfer access.
The User receives only a limited, non-exclusive, and non-transferable license.
11. Sanctions
The User's account may be suspended or canceled if there is:
- violation of these Terms;
- fraudulent behavior;
- improper use of the platform;
- offense to third parties or the system.
12. Immediate Termination
SlabWare may terminate the service and block access without prior notice in case of:
- illicit activity;
- severe violation;
- risk to the system;
- recurring lack of payment..
13. Changes to the Terms and the Service
These Terms may be unilaterally amended for:
- legal adequacy;
- improvements and updates;
- operational adjustments.
SlabWare may modify, suspend, or discontinue features when necessary.
14. Privacy Policy
To use the platform, the User must fully accept the Privacy Policy, which addresses the use, processing, and protection of personal data.
14.1 Google User Data – Job Tracker (Fabricator)
SlabWare may request access to the User's Google account to:
- create, modify, and delete events in Google Calendar;
- synchronize changes made in the Job Tracker.
Data transfer fully follows the Google API Services User Data Policy, including the requirements for Limited Use.
15. Jurisdiction
The parties elect the jurisdiction of the Court of Vila Velha/ES as competent to resolve any controversies arising from these Terms, dismissing any other, no matter how privileged it may be.
